Users can make up to seven CD copies of any particular playlist containing songs purchased from the iTunes Store.
Users can access their songs on up to five computers.
Songs can be read on a computer with iTunes or an iPod, other MP3 players are not compatible with FairPlay encoded tracks.
There is no restriction on the number of iPods to which a purchased song can be transferred nor the number of times an individual song can be burned to CD.
When Apple initially introduced Fairplay, songs purchased from iTunes had limits of three machines and simultaneous CD copies of a ten playlist. Setting the current limit be done with the introduction of iTunes 4.5 in April 2004, presumably as a result of the renegotiation of Apple had with major labels.
technology Apple's DRM is fragile. Several programs have been written to remove the package and let the FairPlay AAC files for use without technological restrictions. Put simply, a user can convert protected files to unprotected MP3 format by burning them to an audio CD and then ripping back to iTunes. (Some audio quality is lost This transcoding a lossy format to another, though the CDs are lossless, usually at the end and beginning formats are both at a loss) Another solution, but also the way of loss of transcoding the files is to record the wave "Out Mix" using an audio recording program (such as Audacity or Audio Hijack Pro) while playing the song in iTunes, and then encoded in a format the user's choice.
Competitors accuse Apple of using iPod, the iTunes Store, and "FairPlay" to establish a vertical monopoly and a lock-in for iPod users use iTunes exclusively (and vice versa). This lock has two aspects:
Apple to maintain tight control of its FairPlay encryption. Other online music stores can not sell music files encoded with FairPlay, and devices competitive companies like Creative Labs and iRiver can not play these files. This means that consumers who want to listen to songs downloaded from the iTunes Store or you must have an iPod or convert the files in an open format.
The iPod can not play files encoded in WMA format from Microsoft or RealNetworks protected propeller is used by other online music stores. IPod users who want to play music from other stores Bypass DRM files.
In July 2004, RealNetworks started an program called Harmony, which converts files purchased RealNetworks RealRhapsody service into a FairPlay-compatible format an iPod could play. In response, Apple accused RealNetworks to "adopt the tactics and ethics of a hacker to break into the iPod." and released a firmware update that made iPods unable to play files type. On January 3, 2005, an iTunes Music Store customers sued, claiming the company had violated U.S. antitrust laws by freezing their competitors.
In 2006, a controversy erupted over a French bill aimed at strengthening the protection of works of art against "piracy" or illegal copying, certain provisions of the law could be used to request Apple to provide information about its FairPlay system to manufacturers of the players competition. Apple pressure groups and partners have protested the bill, and even suggested that tolerates "state-sponsored piracy." Some American commentators have argued that the law was a protectionist measure against the iPod.
Movement Against DRM
On February 6, 2007, Steve Jobs, has asked the Big Four labels registry to allow their music to be sold without DRM. On April 2, 2007, Apple and the record company EMI has announced that the iTunes Store begin offering as an option to purchase additional songs EMI catalog-AAC encoded at 256 kbps without FairPlay DRM or otherwise.
On 29 May 2007 Apple released version 7.2 of its iTunes software, allowing users to purchase DRM-free music and video clips of the participation of the labels. These new files available on the iTunes Store, have been called iTunes Plus music from Apple.
In October 2007, iTunes Plus is no longer an option. It had become automatically for all the contents of iTunes Plus License. In addition, the cost price of iTunes Plus DRM.
Almost immediately after the launch of iTunes Plus, reports surface that sell songs without DRM through the iTunes Store contains the credentials on the client, embedded address full name of the account purchase and email as metadata in the archive. Although this information has always been in iTunes downloads with no DRM and Fairplay, we believe that remains on the slopes as capable to trace the source of illegally share tracks online, where the lack of DRM makes it much easier now. Group concerned about privacy personal data could be misused if the goods to which files have been stolen, and perhaps unfairly incriminate a user in case of copyright infringement.
On January 6, 2009 at Macworld Expo, Apple announced a major review of the catalog of iTunes Plus with Universal Music Group, Sony BMG, Warner Music Group and EMI to offer all their music on iTunes Plus immediately. Since the announcement, 8 million songs have been available in Apple DRM. In April 2009, all songs are available iTunes Plus format, with the exception of the Japanese bank iTunes.

Litigation
Apple Records
Article Home: Apple Corps vs. Apple Computer
For three years, a record of the Beatles Apple Records have been in a legal dispute, Apple Corps v. Apple Computer, Apple Computer the name "Apple." On May 8, 2006, a decision was rendered in favor of Apple Computer, but Apple Records, said it would appeal the decision. Despite this, plans were announced by Neil Aspinall in April 2006 and completely release and re-create the entire Beatles catalog online music service without specifying, and the release of unpublished work by the band. No date has been set yet. Also been reported that the catalog of Beatles music could be initially that only appear in iTunes, which Apple is in talks with the British group EMI online distribution agreement that may be unique for a limited time. In its January 9, 2007 speech of Macworld, Apple, Steve Jobs used the song "Lovely Rita" to present music-playback capabilities of the new iPhone the company. This was seen by industry observers as further evidence that the Beatles catalog will be introduced the iTunes Music Store catalog in a near future. On February 5, 2007, Apple Corps and Apple Inc. announced that they had reached an agreement of their legal disputes. In a related development, Apple announced August 14, 2007 that the entire solo catalog of John Lennon will be available on iTunes. The solo catalogs of the other three Beatles Paul McCartney, Ringo Starr and George Harrison is also available on iTunes. While the official Beatles catalog is not yet available, some of your music by different artists are available.
The Consumer Council of Norway challenge EULA
On June 6, 2006, the Norwegian Consumer Ombudsman, Sweden and Denmark launched a joint letter open to Apple regarding the EULA of iTunes through the Norwegian Consumer Ombudsman Bjørn Erik Thon. The iTunes case is based on a formal complaint by the Consumer Council Norway on January 25, 2006.
Main complaints are:
The EULA is unbalanced to the detriment of the client. Scandinavian law requires that any written agreement to encourage the two parties. The weaker party also enjoys protection from exploitation, in accordance with the laws of Norwegian consumers.
The iTunes Using the store digital rights management limits the number of devices purchased songs can be played on.
iTunes contract authorizing the Company to any time to change the terms of the contract without notice, including the selection of players or software to be used for iTunes files, and the number of times where a customer can modify or copy files and purchased.
The EULA is both vague and difficult to understand for customers.
EULA states the legal relationship between the company and customers is regulated by English contract law. It is not reasonable to expect that Norwegian consumers have a thorough knowledge of English law. The Products marketed to Norwegian consumers in Norway are subject to Norwegian law a right that can not be excluded by a clause in the contract of the company standard client.
The EULA removes responsibility for damages due to iTunes the computer software errors, although the responsibility can not be waived in the Act Scandinavian consumer.
Apple has responded July 31, 2006.
On January 22, 2007, consumer groups, Germans and French have joined forces with Norway and Finland. Its goal is to create a united EU front against iTunes (Germany and France, have had their negotiation process with iTunes.) According to the press release from Apple is in favor of it. The key points in negotiations were:
The interoperability of consumers should have the right and ability to play their music anywhere any device of their choice.
Change iTunes conditions must remove the right to change the terms and conditions (EULA) at any time without the consent of the consumer.
iTunes must change its liability clause limiting their liability for damages to consumers if they are caused by content sold on iTunes.
Applicable to consumers the right to enter into a contract with iTunes should be able to invoke the rules of consumer protection, in accordance the law of the country in which they live.
Competition for the EU
In 2004, Which? magazine has complained to the European Commission about the rise in UK prices for the same songs sold in the EU. Normally € 0.99 in the European Union and 79 pence in the UK. In 2008, the Commission withdrew its investigation after Apple agreed end price discrimination.
Content dispute
Universal Music Group
On July 1, 2007, The New York Times reported that Universal (Now the global music company) would not renew its annual contract to sell music through iTunes. Instead of that, Universal said it would market music to Apple at will, allowing you to remove their songs from the iTunes service on short notice, if both parties agreed on the price or other conditions.
On August 9, 2007, UMG announced a plan to sell songs in MP3 format without digital rights management, through a variety of online services like Amazon GBox MP3 and start-ups. While these issues are still available on the iTunes Store, Universal has chosen to license these songs in DRM-free formats only through other services.
NBC Universal TV series
On August 31, 2007, Apple announced that programming on the NBC television schedule 2007-08 not would be available on iTunes. NBC reported that Apple is the day it would not renew his contract. He then explained that this amendment applies only series produced NBC Universal Studios, owned by Universal Media, including Universal-produced shows on other networks such as the Chamber of Representatives. NBC programs produced by other studies, such as Chuck (Warner Bros.) Companion (20th Century Fox), will be available on iTunes.
Apple has said publicly that NBC did not renew his contract if Apple agreed to a price increase of U.S. $ 4.99 per episode, what is not. NBC disputes that claim, saying that Apple is opposed to the request of the NBC to package shows together and make wholesale prices more flexible. NBC says it never asked to double the price of wholesale and insisted that their emissions will be sold through the iTunes Store and early December. Other networks sell their emissions iTunes did not follow suit, as some predicted would happen. [Citation needed] On 1 December 2007 were dismissed NBC shows from iTunes.
On September 9, 2008, Apple and NBC Universal announced that NBC is once again available on iTunes U.S. Store.
The iTunes Store in the UK has many programs available from NBC, but are distributed by Universal Studios. The price of these stations are higher than they were in the American store, offering an example, season 3 of The Office is priced at UK43.47 (approximately U.S. $ 72) $ 52.99 (United States Store United HD).
